Terms of Service
Please read these Terms of Service ("Terms") carefully before using the Dreamfund website and platform operated by Dream Fund AI LLC ("Dreamfund," "we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.
1. Acceptance of terms
By visiting dreamfund.ai, joining our waitlist, or using any Dreamfund product or service, you confirm that you are at least 18 years old, are located in the United States, and agree to these Terms and our Privacy Policy.
2. What Dreamfund is
Dreamfund is a financial technology platform that enables users to set a home down payment goal and receive gift contributions from family, friends, and community members. Dreamfund converts those community contributions into structured, lender-compliant documentation (HUD gift letters and supporting records) that borrowers can use as part of a home purchase.
Dreamfund is not a bank, mortgage lender, mortgage broker, or financial advisor. Using Dreamfund does not create a loan, deposit account, or lending relationship. Dreamfund does not guarantee mortgage approval, specific loan terms, down payment amounts, or home purchase outcomes.
When Dreamfund's platform launches and holds funds on your behalf, those funds will be held at an FDIC-member partner institution. Dreamfund is not itself an FDIC-insured institution.
3. The waitlist program
Our current Services consist of a waitlist that allows users to reserve early access to the Dreamfund platform when it launches. By joining the waitlist:
- You receive a queue position and a unique referral link
- When friends and family join through your referral link, your queue position advances and you unlock tier status
- Tier status confers no monetary value and creates no financial obligation on either side
- No purchase is necessary to join. The waitlist is free.
- Rewards are queue position and status only. Void where prohibited.
When you share your referral link, the Referrer Terms apply. They prohibit making claims about mortgage rates, approval odds, down payment amounts, or other financial outcomes.
4. Account registration
To join the waitlist or use certain features, you may need to register with your name and email address. You agree to:
- Provide accurate, complete, and current information
- Use your real name and a working email address
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized use of your account
You may not create accounts on behalf of another person without their express permission, or create multiple accounts for the purpose of gaming the referral program.
5. Acceptable use
You agree not to:
- Use our Services for any unlawful purpose or in violation of these Terms
- Submit false, misleading, or fraudulent information
- Use disposable email addresses, bots, automated scripts, or fake accounts to manipulate the waitlist or referral program
- Attempt to circumvent security controls, access controls, or rate limits
- Scrape, crawl, or harvest data from our Services without written permission
- Post or transmit content that is defamatory, harassing, discriminatory, or that infringes the intellectual property rights of others
- Misrepresent Dreamfund's products, capabilities, licensing status, or financial relationships in any public communication
- Engage in marketing practices that violate the Fair Housing Act, Equal Credit Opportunity Act, FTC Endorsement Guides, or CAN-SPAM Act
6. Intellectual property
All content on the Dreamfund website and platform, including text, graphics, logos, icons, images, and software, is the property of Dreamfund, Inc. or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works without our prior written permission.
You retain ownership of any content you submit to Dreamfund (such as your name and referral activity). By submitting content, you grant Dreamfund a non-exclusive, royalty-free license to use that content for the purpose of providing and promoting our Services.
7. Privacy
Our Privacy Policy describes how we collect, use, and share your personal information. By using our Services, you consent to the data practices described in our Privacy Policy.
8. Disclaimers
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Dreamfund is not responsible for the actions of third-party service providers, partner lenders, or other users of our platform. We make no guarantee that joining the waitlist will result in loan approval, home purchase, or any specific financial outcome.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DREAMFUND AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS OR YOUR USE OF THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO DREAMFUND IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100. BECAUSE OUR CURRENT SERVICES ARE FREE, THIS MEANS OUR LIABILITY CAP IS $100.
10. Dispute resolution and arbitration
Please read this section carefully. It affects your legal rights.
You and Dreamfund agree that any dispute, claim, or controversy arising from or relating to these Terms or your use of our Services will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that either party may bring claims in small claims court if the claim qualifies.
Class action waiver: You waive any right to participate in a class action, class arbitration, or representative action against Dreamfund. You may only bring claims against Dreamfund on an individual basis.
To opt out of arbitration, send written notice to Dreamfund, Inc., 971 US Highway 202N, Suite #8307, Branchburg, NJ 08876, Attn: Legal, within 30 days of first agreeing to these Terms. Your opt-out will not affect your ability to use our Services.
11. Governing law
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law principles. Any disputes not subject to arbitration will be brought exclusively in the state or federal courts located in Essex County, New Jersey.
12. Termination
We may suspend or terminate your access to our Services at any time for any reason, including violation of these Terms, without notice or liability. You may stop using our Services at any time. Sections that by their nature should survive termination (including disclaimers, limitations of liability, and dispute resolution) will survive.
13. Changes to these terms
We may update these Terms from time to time. When we make material changes, we will notify waitlist members by email and update the effective date at the top of this page. Continued use of our Services after an update constitutes acceptance of the revised Terms.
